Welcome to America's Math Tutor ("Company," "we," "our," or "us").

By accessing or using AmericasMathTutor.com, registering for a program, purchasing a membership or tutoring service, or participating in any educational activity offered by America's Math Tutor, you agree to be bound by these Terms and Conditions.

If you do not agree to these Terms, please do not use our website or services.


1. Services Provided

America's Math Tutor provides educational programs and services including, but not limited to:

  • Books & Buckets
  • Big Brain Math League (BBML)
  • Individual Tutoring
  • Small-Group Tutoring
  • Educational games and competitions
  • Digital educational resources
  • Parent resources
  • Other educational services that may be offered from time to time

We reserve the right to modify, suspend, discontinue, or replace any program or service at any time.


2. Eligibility

Students under the age of 18 must be registered by a parent or legal guardian.

Parents and guardians are responsible for ensuring students have:

  • Appropriate internet access (for online programs)
  • A compatible computer, tablet, or mobile device
  • Transportation to in-person programs (when applicable)
  • Adult supervision when appropriate

3. Enrollment

Enrollment is subject to availability.

We reserve the right to:

  • Limit enrollment
  • Establish waiting lists
  • Refuse or cancel enrollment
  • Remove participants whose conduct interferes with the learning environment

4. Payment Terms

Program fees are due according to the payment option selected during registration.

Recurring memberships automatically renew unless canceled before the next billing cycle.

Failure to make required payments may result in suspension or termination of services.

Program prices may change at any time.


5. Cancellation and Refunds

Refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference.

By enrolling in any America's Math Tutor program, you acknowledge that you have reviewed and accepted the Refund Policy.


6. Educational Disclaimer

America's Math Tutor strives to provide high-quality educational instruction and enrichment.

However, we do not guarantee:

  • Specific grades
  • Standardized test scores
  • Academic placement
  • School admission
  • Athletic performance
  • Any specific educational outcome

Student success depends on many factors, including attendance, participation, effort, prior knowledge, practice outside the program, and family support.


7. Student Conduct

Students are expected to:

  • Treat instructors, volunteers, and fellow participants with respect.
  • Use appropriate language.
  • Follow directions.
  • Demonstrate good sportsmanship.
  • Participate honestly.
  • Respect program equipment and facilities.

The Company reserves the right to remove any participant whose behavior is disruptive, unsafe, dishonest, or inappropriate.

Examples include:

  • Bullying or harassment
  • Fighting or threatening behavior
  • Cheating
  • Vandalism
  • Repeated failure to follow directions
  • Inappropriate language
  • Conduct that interferes with the safety or enjoyment of others

Participants removed for misconduct are not entitled to refunds.


8. Books & Buckets Participation

Participation in Books & Buckets requires students to complete the weekly Reading Challenge Quiz.

Students must score 80% or higher to participate in that week's basketball session.

Failure to achieve the required score does not constitute grounds for a refund or credit.

Parents understand that participation in basketball activities involves inherent risks associated with recreational sports.

Parents are responsible for ensuring their child is physically able to participate.

America's Math Tutor reserves the right to suspend or remove participants whose behavior creates safety concerns.


9. Intellectual Property

All content provided by America's Math Tutor is protected by copyright and other intellectual property laws.

This includes, but is not limited to:

  • Videos
  • Worksheets
  • Reading materials created by America's Math Tutor
  • Reading Check questions
  • Reading Challenge Quizzes
  • Lesson plans
  • Presentations
  • Educational games
  • Logos
  • Graphics
  • Website content
  • Big Brain Math League materials

Materials may not be copied, reproduced, distributed, sold, or shared without prior written permission.


10. Photography and Media Release

Classes, events, tutoring sessions, and Books & Buckets activities may occasionally be photographed or recorded for educational, promotional, or quality assurance purposes.

By enrolling, parents grant America's Math Tutor permission to use photographs or video recordings that may include participants for promotional purposes.

Parents who do not wish for their child to appear in photographs or promotional materials may submit a written opt-out request through our website before participation.


11. Privacy

We respect the privacy of our students and families.

Personal information is collected only as necessary to:

  • Process registrations
  • Provide educational services
  • Communicate with families
  • Improve our programs
  • Comply with legal obligations

We do not sell personal information to third parties.

12. Technology Requirements

Participants in online programs are responsible for providing:

  • Internet access
  • A compatible device
  • Updated web browser
  • Any required software

America's Math Tutor is not responsible for interruptions caused by:

  • Internet outages
  • Device failures
  • Power outages
  • Third-party software issues

13. Assumption of Risk

Participation in in-person activities, including basketball and other physical activities, involves inherent risks of injury.

By enrolling a child in an in-person program, parents or legal guardians acknowledge these risks and voluntarily assume responsibility for their child's participation.

Parents should ensure their child is physically capable of participating and should notify America's Math Tutor of any medical conditions, allergies, or physical limitations that may affect participation.


14. Limitation of Liability

To the fullest extent permitted by law, America's Math Tutor, its owners, instructors, employees, contractors, volunteers, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in our programs or use of our website.

Our total liability shall not exceed the amount paid for the applicable program or service.


15. Governing Law

These Terms and Conditions are governed by the laws of the State of North Carolina, without regard to its conflict of law principles.


16. Changes to These Terms

America's Math Tutor reserves the right to modify these Terms and Conditions at any time.

Updated versions will be posted on our website with a revised effective date.

Continued use of our website or participation in our programs after changes become effective constitutes acceptance of the revised Terms.
