Welcome to America's Math Tutor and Big Brain Math Academy ("Company," "we," "our," or "us"). By accessing or using this website, enrolling in a program, participating in the Big Brain Math League, Summer Boot Camps, Homeschool Programs, tutoring services, assessments, or any other services offered through www.AmericasMathTutor.com, you agree to be bound by the following Terms and Conditions.
If you do not agree to these Terms and Conditions, please do not use our website or services.
1. Services Provided
America's Math Tutor and Big Brain Math Academy provide educational services including, but not limited to:
- Online math classes
- Homeschool math programs
- Algebra 1 instruction
- Summer Boot Camps
- Big Brain Math League
- Math assessments
- Tutoring services
- Educational games and competitions
- Parent resources and educational materials
We reserve the right to modify, suspend, or discontinue any service at any time.
2. Eligibility
Students under the age of 18 must have permission from a parent or legal guardian to participate in any program or service.
Parents and guardians are responsible for ensuring that students have appropriate internet access, equipment, and supervision as needed.
3. Memberships and Enrollment
Enrollment in any program is subject to availability.
Founding Memberships, promotional pricing, discounts, and special offers are limited and may be modified or discontinued without notice.
We reserve the right to refuse or terminate enrollment for any reason, including violations of these Terms and Conditions.
4. Payment Terms
All fees are due according to the payment schedule selected during registration.
Monthly memberships will automatically renew unless canceled before the next billing cycle.
Failure to make payments may result in suspension or termination of access to services.
Prices, tuition, and membership fees are subject to change. Existing members enrolled under a published "lifetime" founding rate will retain that rate for as long as their membership remains active and in good standing.
5. Cancellation and Refund Policy
Memberships may be canceled at any time.
Unless otherwise stated in writing:
- Monthly membership fees are non-refundable.
- Tuition payments are non-refundable after the program begins.
- Missed classes, competitions, webinars, or activities are not eligible for refunds.
- If a program is canceled by us, a prorated refund or account credit may be issued at our discretion.
6. Free Trials
Free trials are offered at our discretion.
If a payment method is required for a free trial, the membership will automatically convert to a paid membership at the conclusion of the trial period unless canceled before the billing date.
7. Educational Disclaimer
We strive to provide high-quality educational instruction and support.
However, we do not guarantee:
- Specific grades
- Test scores
- Academic placement
- Admission to any school or program
- Any particular educational outcome
Student success depends on many factors including attendance, participation, effort, prior knowledge, and support outside of our programs.
8. Assessments
Free assessments provided through our website are intended solely for informational and placement purposes.
Parents are responsible for administering and scoring any parent-scored assessments.
Assessment results should not be interpreted as professional educational, psychological, or diagnostic evaluations.
9. Student Conduct
Students are expected to:
- Treat instructors and participants respectfully.
- Use appropriate language and behavior.
- Follow directions during live sessions.
- Refrain from disruptive conduct.
The Company reserves the right to remove any participant whose behavior interferes with the learning experience of others.
No refunds will be issued for removals resulting from misconduct.
10. Big Brain Math League Competitions
Participation in contests, challenges, tournaments, rankings, and prize programs is subject to rules established by the Company.
We reserve the right to modify competition formats, scoring systems, prizes, eligibility requirements, and participation requirements at any time.
Prize availability is not guaranteed and may be substituted with prizes of equal value.
11. Intellectual Property
All content provided through America's Math Tutor and Big Brain Math Academy, including but not limited to:
- Videos
- Worksheets
- Assessments
- Lesson plans
- Presentations
- Logos
- Graphics
- Games
- Course materials
is the intellectual property of America's Math Tutor and/or its licensors and may not be copied, distributed, reproduced, sold, or shared without written permission.
12. Recording and Media Release
Live classes, webinars, competitions, or events may be recorded for quality assurance, training, promotional, or educational purposes.
By participating in our programs, you grant permission for the Company to use recordings, screenshots, student first names, testimonials, competition rankings, and similar content for promotional purposes unless a written opt-out request is submitted.
13. Privacy
We take reasonable measures to protect personal information.
Parents are responsible for providing accurate information during registration.
Student information will not be sold to third parties.
We may collect information necessary to provide services, process payments, communicate with families, improve our programs, and comply with legal obligations. Privacy practices relating to student information should be handled consistently with applicable educational and children's privacy requirements.
14. Technology Requirements
Participants are responsible for:
- Internet access
- Computer, tablet, or mobile device
- Zoom access (if applicable)
- Any required software or browser updates
We are not responsible for interruptions caused by internet outages, equipment failures, or third-party software issues.
15. Limitation of Liability
To the fullest extent permitted by law, America's Math Tutor, Big Brain Math Academy, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services. Liability shall not exceed the amount paid by the participant for the applicable service.
16. Governing Law
These Terms and Conditions shall be governed by and interpreted under the laws of the State of North Carolina, without regard to conflict of law principles.

We reserve the right to modify these Terms and Conditions at any time.
Updated versions will be posted on this website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms and Conditions.
